The questions

Answer based on the business as it is today. Nothing is stored until you order.

The business

What kind of employer are you?
How many permanent full-time employees do you have in Denmark today?

Count only permanent full-time employees. Temporary agency workers, part-time staff and fixed-term employees do not count.

Has the business been operating for at least 2 years?
Have you prepared an annual report (public employers: annual accounts) for each of the last 2 years?

Collective agreement and control

How are you covered by a collective agreement?
Are the positions you want to fill with foreign workers covered by the agreement?
Is the agreement a salaried-staff agreement that is still dormant under the 50 % rule?

A dormant agreement only applies once the union has shown that at least half of the employees in the area are members. Most answer no.

Do you know which union is party to the agreement?
Will you give the union ongoing access to check that the agreement is complied with for the foreign employees?
Do you have an elected union representative in the agreement area where the foreign workers will be employed?

Compliance record

Has the business been ordered to pay a fine (bod) by the Labour Court or industrial arbitration for underpaying foreign workers within the last 2 years?
Is the business currently subject to a lawful industrial dispute (strike or lockout)?
Does the business have an immediate enforcement notice (strakspåbud) from the Danish Working Environment Authority that has not been complied with?
Has the business been convicted of illegal employment of foreign nationals within the last year (Aliens Act section 59(5) or section 60(1))?
Does the business have overdue debt to public authorities (e.g. tax, VAT, withholding tax, labour market contribution or ATP)?
Is the business in bankruptcy, compulsory composition, insolvency or liquidation proceedings?
Has the business or a member of the board or management been convicted of bribery, fraud, money laundering, terrorism, participation in a criminal organisation, child labour or human trafficking?

These are the matters shown on the Danish Business Authority's service certificate (Public Procurement Act sections 135 and 137), for the periods the certificate covers.

The guidance meeting

Can a member of your management, employed by you, attend SIRI's guidance meeting?

A lawyer, a recruitment agency or just any employee cannot attend instead.

Questions and answers

Who needs to be certified?

The employer that wants to hire foreign workers under the new collective-agreement-based pay limit scheme. Certification applies to the CVR number that applies. A fast-track certification does not give access to the new scheme.

When can we apply?

The act enters into force on 1 January 2027. As of 7 October 2026, SIRI has not published the application form. You can prepare everything now.

What does SIRI charge?

The certification fee is DKK 6,810 in 2026 (executive order 1612/2025). The 2027 rate has not been published. The fee is paid no later than with the application.

How long is certification valid?

3 years the first time and then 4 years at a time when extended (section 9 a(23) of the Aliens Act).

Can our lawyer or recruitment agency attend the guidance meeting?

No. According to the explanatory notes to the act, it must be a member of your management who is employed by the business.

Is this legal advice?

No. The check and the pack are based on the legal text and your own answers. SIRI decides the case. If your case is unclear, e.g. because of a fine, a conviction or a restructuring, talk to a lawyer or your employers' organisation.
